SMART BOARD DECISION ON JUSTIN GUMLEY MOTORSPORTS APPEAL
Martinsville, VA (April 9, 2023)- On Saturday, April 7, 2024, after post-race technical inspection at Orange County Speedway in Rougemont, NC, SMART Modified Tour tech officials found an unapproved intake manifold on the winning car of Blake Barney.
In accordance with SMART rule book, the Justin Gumley Motorsports number-27 was disqualified from the event. Justin Gumley Motorsports appealed the decision.
Following a review by the SMART Appeals Board, it has been determined that the victory by Justin Gumley Motorsports has been voided due to the use of an unapproved part. This board’s decision, however, removes the disqualification, and results in the team being placed in the last position.
The appeals board found the part in question was an oversight, although it was clearly marked as unapproved in the rule book, and was not intentional by Justin Gumley Motorsports or its driver.
